Genral Terms and Conditions
Scope
These general terms and conditions apply to all orders placed by customers resident in Switzerland or the Principality of Liechtenstein via the online shop of Verreaux Swiss, Riedmatt 39, 6300 Zug, Switzerland, +41 79 555 40 30, hello@vswiss.shop www.vswiss.shop ID: CHE-258.165.085, hereinafter referred to as Verreaux Swiss.
Offer and conclusion of contract
2.1 The presentation of the products on www.vswiss.shop does not constitute a legally binding offer, but rather an invitation to the customer to place a binding order (offer to conclude a contract).
2.2 By clicking the order button, the customer places a binding order for the products listed on the order page.
2.3 Immediately after receiving the order, Verreaux Swiss will confirm receipt of the order by email. The purchase contract is only concluded when Verreaux Swiss confirms the dispatch of the goods by e-mail (order or dispatch confirmation) or at the latest when the goods are delivered.
2.4 If payment is made in advance, the purchase contract is concluded when Verreaux Swiss confirms receipt of the advance payment.
Return Policy
3.1 Customers have the right to return the goods within 14 days after delivery of the goods. The right of return is exercised by returning the goods, a justification is not required. The return must be sent to Verreaux Swiss, Returns, Riedmatt 39, CH-6300 Zug.
3.2 Exercising the right of return results in the conversion of the purchase contract into a rescission relationship, after which the services received under the purchase contract must be reimbursed. The consumer bears the costs for the return.
3.3 After receipt of the goods, any purchase price already paid will be refunded to the customer immediately.
3.4 We reserve the right to deduct the purchase price to be refunded or an invoice for possible damage, excessive wear, and tear of the goods or, if agreed, the costs of sending the goods. No deduction is made if the loss in value is due to the handling necessary to determine the type, quality, and functionality of the goods. Verreaux Swiss may refuse repayment until it has received the goods back or until the customer has provided proof that he has sent back the goods, whichever is earlier.
3.5 The right of return is excluded for the following products:
- Customized and individualized items
- If the original packaging is missing
- If accessories are missing
- Consumables
- For hygienically questionable articles
Prices and shipping cost
4.1 The prices stated on the product page include statutory VAT and others Price components and are in Swiss francs (CHF).
4.2 In addition to the prices shown, depending on the delivery address, the quantity of goods and the item Shipping costs apply. The exact shipping costs are displayed to the customer in the ordering process. There are no additional costs for deliveries within Switzerland.
Terms of Delivery
5.1 Delivery is only made to delivery addresses within Switzerland and the Principality of Liechtenstein.
5.2 The standard delivery time is 2-4 working days, unless otherwise stated in the offer.
5.3 If not all ordered products are in stock, Verreaux Swiss is entitled to make partial deliveries. Due to partial deliveries, the customer does not incur any additional costs.
5.4 If the delivery of the goods fails through the fault of the customer despite three delivery attempts, Verreaux Swiss can withdraw from the contract. Any payments made will be refunded.
Terms of Payment
6.1 Payment is made by credit cards, Apple Pay, Google Pay and Stripe.
6.2 If you select the payment method in advance (if offered), Verreaux Swiss will provide its bank details in the order confirmation. The invoice amount must be transferred to the Verreaux Swiss account within 3 days.
6.3 When paying by credit card, the customer’s account is debited with the order confirmation, unless otherwise agreed. At the time of the order, a reservation of the order value is made.
6.4 Offsetting against counterclaims that are not recognized or have not been legally established of the customer is excluded.
6.5 The customer can only exercise a right of retention if the claims are based on the same contractual relationship.
Default of payment / reminder / debt collection (if purchase on account is part of the offer)
7.1 In the case of delivery on account, the purchase price is due within 30 days of delivery of the goods. If payment is not made within this period, the customer is in default.
7.2 In the event of default, Verreaux Swiss will remind the customer twice in writing by email. The following fees are due with the reminder of the claim:
1st reminder after 5 days 0 CHF
2nd reminder after 10 days 20 CHF
Last reminder after 15 days 50 CHF
In addition to the reminder fees, default interest of 10% from the due date of the claim will also be charged.
If the outstanding amount is not paid even after the last reminder, the claim will be pursued. Verreaux Swiss hands over the claim to the company inkassodata AG for enforcement.
Retention of Title
The goods remain the property of Verreaux Swiss until full payment has been made. Before the transfer of ownership, pledging, transfer of ownership, processing or transformation is not permitted without the consent of Verreaux Swiss.
Warranty
9.1 Verreaux Swiss provides a warranty by remedying defects. This is done at your option through supplementary performance, namely elimination of a defect (rectification) or delivery of a defect-free item (replacement delivery).
9.2 If the supplementary performance fails, the customer is entitled to withdraw from the contract. this applies not for minor defects. A right of the customer to reduction is excluded.
Liability
Verreaux Swiss excludes liability for slightly negligent breaches of contract. The same applies to Breaches of contract by auxiliary persons and substitutes.
Privacy
Verreaux Swiss undertakes to comply with data protection regulations when processing customer data. Jurisdiction
The exclusive place of jurisdiction for any disputes is the registered office of Verreaux Swiss.
Final Provisions
Should a provision of these general terms and conditions be ineffective, the otherwise the contract is effective. The relevant provisions shall apply in place of the ineffective provision legal regulations.
